1. Taraflar, kapsam ve kabul

Bu Marka Kullanım Koşulları, FLIT'i işleten MFB Teknoloji ve Yazılım Limited Şirketi ("FLIT") ile FLIT marka panelinde hesap açan marka arasındadır. Bu metinde "sen" markasın. Markayı temsilen kabul eden kişi, temsil yetkisi olduğunu ve markanın ticari amaçla hareket ettiğini beyan eder.

Bu Koşullar, Marka Sözleşmesi ile birlikte uygulanır; ikisi birlikte yayınlanır ve aynı sürüm numarasını taşır. Güncel sürümü panelde açıkça kabul etmeden etkinlik açamazsın; yalnız paneli ziyaret etmek kabul sayılmaz. Konuya özgü hüküm genel hükümden önce gelir; emredici mevzuat saklıdır.

2. Hesabın ve yetkin

Hesabındaki kişilerin yetkilerini doğru yönetmek ve girişini korumak sende. Şirket, temsilci, internet sitesi ya da iletişim bilgilerinde esaslı bir değişiklik olursa FLIT yeniden inceleme ya da yeniden kabul isteyebilir.

3. Etkinlikler ve oyun kuralları

Dört tür etkinlik açabilirsin: turnuva, canlı yarışma, anket ve tahmin.
Etkinlikler beceriye dayanır. Turnuva ve canlı yarışmada kazananı skor belirler: puanlar eşitse daha kısa sürede bitiren, puan ve süre de eşitse sonucunu önce gönderen öne geçer. Çekiliş, kura ya da rastgele seçim yoktur ve sen de ekleyemezsin; şans, bahis ya da kumar niteliği taşıyan hiçbir mekanik kullanılamaz.
Anket ve tahminde kazanan yoktur; kazanana ayrıca ödül verilmez.
Oyuncu katılmak için bir şey ödemez ve bir şey satın almak zorunda değildir.

Etkinliğinde verebileceklerin

Turnuva ve canlı yarışma: katılan herkese katılım indirimi; kazananlara dijital kod; kazanana fiziksel ürün.
Anket ve tahmin: katılan herkese katılım indirimi.

Katılım indirimi, sitende geçerli bir kod ya da kasanda gösterilen bir indirim olabilir; hangi etkinlik türünde hangisinin açık olduğunu panel gösterir. Katılım indirimi ödül değil indirimdir: skora ya da sıraya bağlı değildir ve şartı taşıyan herkese verilir. Onu ilk gelen birkaç kişiye ya da en yüksek skorlulara daraltamazsın; daraltılırsa ödül sayılır ve ödül kuralları uygulanır.

Nakit ya da nakde çevrilebilir ödül yasaktır. FLIT'in ürün içi ödül üst sınırı bir platform güvenlik kuralıdır; hukuki bir azami sınır iddiası değildir ve vergi sorumluluğunu ortadan kaldırmaz.

Kargo yoktur. Fiziksel ödül yalnız senin kasandan teslim alınır; bu yüzden fiziksel ödülü yalnız kasası olan markalar verebilir ve FLIT fiziksel ödüllü etkinlik için ek doğrulama ister. Etkinliği açarken teslim yerini (şube, adres, il) ve koşullarını yazarsın; oyuncu katılmadan önce görür.

4. Ödüller ve katılım indirimi

Etkinlikte ilan ettiğin ödül, indirim ya da kod sana karşı bağlayıcıdır; ödülü ve indirimi sen verir ve karşılarsın. Stok, teslim, kullanım koşulu, geçerlilik tarihi ve varsa bölgesel ya da ürünsel sınırlamaları etkinlikten önce doğru yazarsın.
Dijital ödül bir koddur; oyuncu kodu uygulamada görür. Fiziksel ödülde oyuncu, FLIT'te gördüğü kodu kasanda gösterir; sen kodu panelde eşleştirip ödülün teslim edildiğini işaretlersin. Ödülün zamanında ve güvenli teslimi sendedir.
Oyuncu ödülünü, kazandığı tarihten itibaren 30 gün içinde talep eder; bu süre dijital ve fiziksel ödülün ikisi için de aynıdır. Bu sürede talep edilmeyen ödül sıralamadaki bir sonraki uygun oyuncuya geçer; bir ödül en fazla üç kez geçer, sonra sana döner.
Etkinliği yayınladığın andan itibaren ödüller, sıralama kuralı, katılım koşulları ve katılım indirimi koşulları değişmez. Panelde bunları düzenleyen bir yer yoktur; oyuncunun aleyhine FLIT de değiştirmez. Farklı bir şey istiyorsan, iptal edilebiliyorsa (madde 11) etkinliği iptal edip yenisini açarsın.
Oyuncunun kazandığı ödülü ve aldığı katılım indirimini, etkinlik bittikten, iptal edildikten ya da sen hesabını kapattıktan sonra da ilan ettiğin son tarihe kadar karşılarsın.

5. Reklam kuralları

FLIT marka etkinliklerini uygulamada "Reklam" etiketiyle ve markanın adıyla gösterir; etiketi kaldırmak ya da gizlemek mümkün değildir. Reklam mevzuatında sen reklam verensin, FLIT etkinliğini yayınlayan mecra kuruluşudur; ikiniz de bu mevzuata ayrı ayrı uymakla yükümlüsünüz.
Yanıltıcı ya da aldatıcı ifade, doğrulanamayan üstünlük iddiası, garanti kazanç dili, hukuka aykırı sağlık ya da finans iddiası, nefret ya da müstehcen içerik ve üçüncü kişilerin haklarını ihlal eden içerik kullanamazsın. FLIT otomatik ya da elle kontrol yapabilir; kontrol yapılması senin sorumluluğunu kaldırmaz.
Her indirim için panelde şunları doğru ve eksiksiz yazarsın: indirimin geçtiği ürün ya da hizmetleri adlarıyla; her biri için indirimin kullanılacağı kanaldaki (kasa ya da internet sitesi) indirimden önceki fiyatı; indirimin başlangıç ve bitiş tarihini; kontenjan koyuyorsan miktarı. Mallarda indirimden önceki fiyat, indirimin başlangıcından önceki on gün içinde o kanalda uygulanan en düşük fiyattır; hizmetlerde indirimli fiyattan bir önceki fiyattır. Yazdığın fiyat tüm vergiler dahil toplam satış fiyatıdır ve oyuncuya olduğu gibi gösterilir. Bunu hem Vitrin indirimlerinde hem etkinliklerin katılım indirimlerinde yaparsın; ürün ve fiyat yazmadan indirim kaydedilmez.
FLIT bu beyanları doğrulamaz; beyanı, beyan zamanını ve beyanı yapan hesabı kaydeder. Beyanların doğruluğundan sen sorumlusun. Bir beyanın gerçeğe aykırılığı nedeniyle FLIT'e yöneltilen idari yaptırım, tazminat ya da masraf, senin bu aykırılığından kaynaklanan kısmıyla sana rücu edilir.
İndirim metinlerinde "bedava", "bedelsiz", "ücretsiz" gibi, oyuncunun ödeme yapmadan edindiği izlenimini veren ifadeleri (gerçek bir "ücretsiz teslimat" bilgisi hariç) ve tek başına "hediye" sözünü kullanmazsın. Bir indirim için "kazandın" demezsin: "kazan" yalnız skorla kazanılan ödül için kullanılır. Panel Vitrin metinlerinde bu ifadeleri reddeder; kural katılım indirimi metinleri için de geçerlidir.
FLIT bir Reklam Kurulu ya da Bakanlık bildirimi aldığında ilgili etkinliği ya da indirimi hemen durdurabilir; internet içeriğinin yirmi dört saat içinde çıkarılması istenebildiği için yanıtını beklemeyebiliriz. Kararın gerekçesini sorabilir, itiraz edebilirsin.

6. Ödül vergisi

Etkinliği yasal olarak sen düzenlersin; ödülü sen verirsin. Veraset ve intikal vergisi mevzuatında yarışmayı düzenleyen, ödüllerden kesilen vergiyi beyan etmekle yükümlüdür (VİVK md. 7). Bu yüzden skorla kazanılan ödüllerin vergisi (VİV) senindir: vergi doğuyorsa kesinti, beyan ve ödeme sana aittir. Oran %20'dir; ayni ödülde fatura değeri esas alınır. Beyan, yarışmanın yapıldığı günü takip eden ayın 20'sinin akşamına kadar verilir. Ödüller her yıl yeniden belirlenen bir istisna tutarına kadar vergiden müstesnadır (VİVK md. 4); bu tutarın nasıl uygulandığını denetlemek ve aşıldığında kesinti ile beyanı yapmak sendedir.

FLIT senin adına vergi kesmez, beyan etmez ve ödemez. Vergi dairesi bu yükümlülüğü FLIT'ten isterse FLIT ödediği tutarı sana rücu eder. FLIT'in kendi marka hesabından açtığı etkinlikleri MFB düzenler; onların vergisi MFB'nindir.

7. Oyuncu verisi

Hiçbir oyuncunun kimliği sana gitmez: kullanıcı adı, e-posta, telefon, adres ve hesap numarası hiçbir zaman gönderilmez. Panelde yalnız toplu sayıları görürsün.
Kasada bir oyuncu telefonunda bir kodu gösterdiğinde yalnız kodu, indirimi ya da ödülü ve saati görürsün. Bu bilgiyi yalnız indirimi ya da ödülü uygulamak için kullanır, bir oyuncuyu tanımlamaya ya da izlemeye çalışmazsın.
FLIT'e oyuncu hakkında raporlama yükümlülüğün yoktur; FLIT'e satış raporu vermekle de yükümlü değilsin.
Kendi kanallarından edindiğin kişisel veriler için 6698 sayılı Kanun'a uymak sana aittir. FLIT üzerinden gördüğün hiçbir bilgiyi bir oyuncuyla eşleştirmeye çalışmazsın.

8. İlk yayın incelemesi

Yeni bir marka ilk yayınını kamuya açmadan önce şirket bilgilerini tamamlar, güncel metinleri kabul eder ve Marka Temsilcisi Aydınlatma Metni'ni görüntüler. İlk yayın, etkinlik ya da Vitrin indirimi hangisi önce gelirse, FLIT'in onayından geçer. Bu bir satış görüşmesi değil, gerçek bir marka olduğunun güven kontrolüdür; incelenen markanın kendisidir.

Onaydan sonra, deneme sürecindeki marka da dahil, 3. maddede yazan her şeyi verebilirsin; sonraki yayınlar ek bir inceleme istemez (fiziksel ödüllü etkinlikteki ek doğrulama hariç). Değişiklik istersek düzeltip yeniden gönderebilirsin. Red, ilgili başvuruyu yayınlamaz; açık bir hesap yaptırımı kararı yoksa hesabının kapatılması anlamına gelmez.

9. Deneme ve ücret

Vitrin teklifinin ayrıca ücreti yoktur. Vitrin'de indirim açmak, kod yüklemek ve görünmek için panel ücreti dışında FLIT'e ücret, komisyon ya da pay ödemezsin. Vitrin'in kuralları Vitrin Katılım Koşulları'ndadır.
Kendi açtığın etkinlikte yalnız oynayan oyuncu başına ödersin. Oynayan oyuncu, etkinliği sonuna kadar tamamlayandır: turnuvada oturumun sorularını tamamlayan, canlı yarışmada yarışmanın sonuna kadar kalan, tahminde tahminini gönderen, ankette tüm soruları cevaplayan. Etkinlik başına sabit ücret yoktur; katılımcı bedeli aylık panel ücretiyle birlikte aşağıdaki maddeye göre hesaplanır. Bir etkinliğin bitip bitmediğine ve katılımcı sayısına FLIT'in sunucu kayıtları esas alınır; katılımcı sayısını panelde görürsün.
FLIT yöneticisinin senin adına açtığı etkinlik ücretsizdir. Markanı kimin oluşturduğundan bağımsız olarak, yöneticinin kendi admin panelinden açtığı etkinliğin katılımcı bedeli 0 TL'dir. Bu etkinlik tek başına aylık panel ücreti başlangıcını tetiklemez. Senin marka panelinden açtığın etkinliklere bu istisna uygulanmaz.
Panel ücreti. Marka paneli için aylık panel ücreti ödersin; yalnız Vitrin kullanıyorsan da. Panel ücreti marka panelinden açtığın ilk etkinliğin ya da ilk Vitrin teklifinin yayına girdiği takvim ayında başlar; o ay ve sonraki ay panel ücreti alınmaz. Sonraki her ay panel ücreti 500 TL'dir (KDV dahil) ve o ayın 500 TL'ye kadar katılımcı bedelini kapsar; aşan katılımcı bedeli ayrıca eklenir. Örnek: katılımcı bedeli 800 TL olan ay 800 TL, 200 TL olan ay 500 TL tutar. Hiç yayını olmayan marka panel ücreti ödemez. Panel ücretinin tutarı ve kapsadığı kullanım yalnız ileriye dönük ve senin açık kabulünle değişir.
Katılım için telefon doğrulaması istenmediğinden aynı kişi birden fazla hesapla katılabilir; ücret hesap başınadır. Birden fazla hesapla katılmak FLIT'in kurallarında yasaktır.
Birim ücretler KDV dahildir; FLIT'in fiyat kartında yazar ve etkinliği oluşturmadan önce panelde sana gösterilir. Açtığın etkinliğin ücreti sabit kalır. FLIT ücreti tek taraflı değiştirmez: yeni bir ücret yalnız yeni açılan etkinliklere ve senin açık kabulünle uygulanır.
Admin tarafından açılan marka istisnası. FLIT yöneticisinin oluşturduğu ve bu şekilde kayıtlı marka hesabında aylık panel ücreti kalıcı olarak 0 TL'dir; 500 TL'lik kapsanan katılım bedeli bu hesaba uygulanmaz. Etkinlik açarsan deneme ve tamamlanan katılımcı başına bedel koşulları uygulanır. Marka hesabının sonraki yönetim değişiklikleri bu istisnayı kaldırmaz.
Deneme: her hukuki işletme için bir kez, 30 gün ya da 3 etkinlik, hangisi önce dolarsa. Denemede ücret yoktur. Bu sürümden önce başlamış denemeler 4 etkinlikle sürer. Deneme ilk onaylı yayından itibaren sayılır; aynı hukuki işletmeye bağlı birden fazla marka tek deneme hakkını paylaşır, hesap değiştirerek yenilenmez. İptal ettiğin etkinlik tüketilmiş deneme hakkını geri vermez; FLIT kaynaklı doğrulanmış bir teknik hata için ayrı, kayıtlı bir düzeltme uygulanabilir.
Ücretli faturalama FLIT bunu açana kadar başlamaz ve o güne kadar senden hiçbir şey tahsil edilmez. Deneme bitince ücretli faturalama kendiliğinden başlamaz; ücretli faturalama açık değilken deneme hakkı dolmuş bir marka yeni etkinlik açamaz, Vitrin'i kullanmaya devam eder. Ücretli faturalama açıldığında nasıl işleyeceği bir sonraki maddede yazar.

10. Ücretli faturalama: kart, otomatik çekim ve fatura

Bu madde, ücretli faturalama başladığında işleyişi anlatır; o güne kadar hiçbir şey çekilmez. Kartının saklanması ve her ay otomatik çekim senin aleyhine sayılabilecek şartlardır. Bu yüzden onlar için, bu Koşullar'ı kabul etmenden ayrı olarak, panelde işaretlenmemiş gelen ayrı bir kutuyla açık onayını isteriz. Bu Koşullar'ı kabul etmek o onayı vermek anlamına gelmez; onayı vermezsen kartın tanımlanmaz ve hiçbir çekim yapılmaz.

Kartı kim saklar. Kartı lisanslı ödeme kuruluşu iyzico saklar; FLIT saklamaz. FLIT yalnız kartı iyzico'da tanıyan bir belirteç ile çekim sonuçlarını tutar. Kartı panelde sen tanımlarsın ve kartın markaya ait olduğunu, çekim için yetkili olduğunu beyan edersin.
Ne zaman, ne için çekilir. Her ayın tutarı, ayı izleyen ayın başında, sonradan, kayıtlı kartından otomatik çekilir. Peşin tahsilat yoktur.
Tutar nasıl hesaplanır. Tutar, o ay etkinliklerini sonuna kadar tamamlayan oyuncu sayısı ile etkinlik türünün birim ücretinin çarpımıdır (madde 9). Sayım FLIT'in sunucu kayıtlarına göredir ve panelde görünür. Bir tutara 30 gün içinde info@mfbteknoloji.com adresine yazarak itiraz edebilirsin.
KDV. Birim ücretler KDV dahildir.
Çekim başarısız olursa. Çekim başarısız olursa ilk başarısız çekimin 3. ve 7. gününde yeniden denenir. 8. günün sonunda tutar hâlâ ödenmemişse yeni etkinlik açamazsın. O sırada süren etkinliklerin sona erene kadar devam eder; çünkü oyunculara verilen ödül ve indirim sözü bozulmaz.
Kartı değiştirmek ve kaldırmak. Kartı panelden istediğin zaman değiştirebilir ya da kaldırabilirsin. Kartı kaldırırsan yeni etkinlik açamazsın; oluşmuş borç ortadan kalkmaz.
Fatura. Faturanı Paraşüt üzerinden e-fatura ya da e-arşiv olarak otomatik keser ve markanın kayıtlı e-posta adresine göndeririz. Fatura için gereken unvanın, vergi kimlik numaranın ve adresin doğru olması sendedir.

Bu onayın sürümü, zamanı ve onaylayan hesap kaydedilir; onayladığın metnin bir kopyası e-postana gelir.

FLIT yalnız kendi hizmet bedelini tahsil eder. Hiçbir zaman başkası adına para almaz, tutmaz ya da aktarmaz: ödüllerin, indirimlerin ve satışların parası FLIT'ten geçmez. FLIT bir ödeme kuruluşu değildir; kartı lisanslı ödeme kuruluşu işler.

11. İptal

Etkinliği iptal etme talebin etkinliği anında durdurmaz. Talep FLIT'in incelemesine gider; iptal kesinleşene kadar etkinlik ve oluşan kayıtlar sürer. Turnuva ve canlı yarışma yalnız başlamadan önce; anket yayındayken; tahmin yayındayken ya da sonuç incelemesindeyken iptal edilebilir. Bitmiş bir etkinlik ve ödül talebi alınmış bir etkinlik iptal edilemez.

İptal katılımı geri almaz: oyuncuların aldığı katılım indirimi ve ödüller yerinde kalır. İptale kadar etkinliği sonuna kadar tamamlayan oyuncular için ücret doğar. Olağan iptal deneme hakkını geri yüklemez.

12. FLIT'in müdahalesi

FLIT; güvenlik, sahtecilik, hukuka aykırılık, oyuncu zararı, ödül ya da teslim riski, bir Reklam Kurulu ya da Bakanlık bildirimi veya bu Koşullar'ın ihlali halinde bir etkinliği ya da indirimi yayınlamayabilir, durdurabilir, incelemeye alabilir; borç ya da ağır ihlal halinde hesabının yeteneklerini sınırlayabilir ya da hesabı askıya alabilir. FLIT'in bir etkinliği durdurması, oyuncunun o ana kadar kazandığı ödülü ve aldığı indirimi ortadan kaldırmaz; bunları karşılamaya devam edersin.

13. Düzenleyen, sorumluluk, Apple ve Google

Etkinliği yasal olarak sen düzenlersin; MFB platformu işletir. FLIT'in kendi marka hesabından açtığı etkinliği MFB düzenler ve ekranında düzenleyenin FLIT olduğu yazar.
FLIT platformun teknik yayın ve kayıt katmanını sağlar; senin ticari vaadini üstlenmez. Ödüle ya da indirime konu ürün veya hizmetin satıcısı, tedarikçisi ya da garantörü değildir. Satış, ödeme, teslimat, iade ve garanti konularındaki yükümlülükler sana aittir.
Yüklediğin içerik ve işaretler için gerekli kullanım hakkına sahip olduğunu garanti edersin. Üçüncü kişi iddiası, idari yaptırım ya da zararın senin kendi aykırılığından kaynaklanan kısmından sen sorumlusun. FLIT'in emredici mevzuattan doğan sorumlulukları saklıdır.
Uygulamada resmi kurallar her etkinliğin içinde açılabilir ve şu cümle yer alır: "Apple ve Google bu etkinliğin sponsoru değildir ve etkinlikle hiçbir şekilde ilgili değildir."
Apple ödüllü marka etkinliklerini kabul etmezse bu etkinlikler iOS'ta kapatılabilir; bu durum yalnız katılımcı sayını etkiler, çünkü ücret yalnız oynayan oyuncu başınadır.

14. Sürüm ve kabul kaydı

Bu Koşullar ya da Marka Sözleşmesi değiştiğinde yeni sürüm, yeni etkinlik açmadan önce panelde yeniden açık kabulünle yürürlüğe girer; sessiz kabul yoktur. Eski sürümle açtığın etkinlikler o sürümle devam eder; senin aleyhine bir değişiklik geriye yürümez. Kabulün sürümü, zamanı ve kabul eden hesap kaydedilir. Bu metinler bu sayfada her zaman açıktır; yazdırabilir ya da kaydedebilirsin.

1. Parties, scope and acceptance

These Brand Terms of Use are between MFB Teknoloji ve Yazılım Limited Şirketi, which operates FLIT ("FLIT"), and the brand that opens an account on the FLIT brand panel. In this text "you" means the brand. The person who accepts on behalf of the brand declares that they have the authority to represent it and that the brand acts for commercial purposes.

These Terms apply together with the Brand Agreement; the two are published together and carry the same version number. You cannot open an event without explicitly accepting the current version on the panel; merely visiting the panel does not count as acceptance. A provision specific to the subject takes precedence over a general provision; mandatory legislation is reserved.

2. Your account and your authority

Managing the permissions of the people on your account correctly and protecting your sign-in is up to you. If there is a material change in your company, representative, website or contact information, FLIT may ask for a new review or a new acceptance.

3. Events and game rules

You can open four types of event: tournament, live contest, survey and prediction.
Events are based on skill. In a tournament and a live contest the score decides the winner: if points are tied, whoever finishes in the shorter time comes first, and if points and time are both tied, whoever submitted the result first comes first. There is no draw, lottery or random selection, and you cannot add one; no mechanic of the nature of chance, betting or gambling can be used.
In a survey and a prediction there is no winner; no prize is given to a winner separately.
A player pays nothing to take part and does not have to buy anything.

What you can give in your event

Tournament and live contest: a participation discount to everyone who takes part; a digital code to the winners; a physical product to the winner.
Survey and prediction: a participation discount to everyone who takes part.

A participation discount can be a code valid on your website or a discount shown at your counter; the panel shows which one is open for which type of event. A participation discount is a discount, not a prize: it does not depend on score or rank and is given to everyone who meets the condition. You cannot narrow it to the first few people to arrive or to the highest scorers; if it is narrowed, it counts as a prize and the prize rules apply.

Cash or cash-convertible prizes are forbidden. FLIT's in-product upper limit on prizes is a platform safety rule; it is not a claim of a legal maximum and does not remove tax liability.

There is no shipping. A physical prize is collected only at your counter; for this reason only brands that have a counter can give a physical prize, and FLIT asks for additional verification for an event with a physical prize. When you open the event you write the delivery place (branch, address, province) and its conditions; the player sees them before taking part.

4. Prizes and the participation discount

The prize, discount or code you announce in an event is binding on you; you give and fulfil the prize and the discount. You write stock, delivery, terms of use, validity date and any regional or product limitations correctly before the event.
A digital prize is a code; the player sees the code in the app. For a physical prize, the player shows the code they see in FLIT at your counter; you match the code on the panel and mark the prize as delivered. Timely and safe delivery of the prize is your responsibility.
A player claims their prize within 30 days of the date they won it; this period is the same for both digital and physical prizes. A prize not claimed within this period passes to the next eligible player in the ranking; a prize passes at most three times, then returns to you.
From the moment you publish the event, the prizes, the ranking rule, the participation conditions and the participation discount conditions do not change. There is no place on the panel to edit them; FLIT does not change them to the player's detriment either. If you want something different and the event can be cancelled (Article 11), you cancel the event and open a new one.
You fulfil the prize a player has won and the participation discount a player has received up to the last date you announced, even after the event ends, is cancelled, or you close your account.

5. Advertising rules

FLIT shows brand events in the app with the "Reklam" (Advertisement) label and the brand's name; it is not possible to remove or hide the label. Under advertising legislation you are the advertiser and FLIT is the media service provider that publishes your event; each of you is separately obliged to comply with this legislation.
You may not use misleading or deceptive statements, unverifiable superiority claims, guaranteed-earnings language, unlawful health or financial claims, hateful or obscene content, or content that infringes the rights of third parties. FLIT may check automatically or manually; the fact that a check is made does not remove your responsibility.
For every discount you write the following on the panel correctly and completely: the products or services the discount applies to, by name; for each of them, the price before the discount in the channel where the discount will be used (counter or website); the start and end date of the discount; and the quantity if you set a quota. For goods, the price before the discount is the lowest price applied in that channel in the ten days before the start of the discount; for services it is the price immediately before the discounted price. The price you write is the total sale price including all taxes and is shown to the player as it is. You do this both for Vitrin discounts and for the participation discounts of events; a discount is not saved without a product and a price.
FLIT does not verify these declarations; it records the declaration, the time of the declaration and the account that made it. You are responsible for the accuracy of the declarations. Any administrative sanction, compensation or expense directed at FLIT because a declaration is untrue is passed on to you by way of recourse, to the extent it arises from your breach.
In discount texts you do not use expressions such as "free" ("bedava", "bedelsiz", "ücretsiz") that give the impression that the player obtains something without paying (except real "free delivery" information), nor the word "gift" ("hediye") on its own. You do not say "you won" ("kazandın") for a discount: "win" ("kazan") is used only for a prize won by score. The panel rejects these expressions in Vitrin texts; the rule also applies to participation discount texts.
When FLIT receives a notice from the Advertisement Board or the Ministry, it may stop the relevant event or discount immediately; because the removal of internet content can be required within twenty-four hours, we may not wait for your reply. You can ask for the reasons for the decision and can object.

6. Prize tax

You are the legal organiser of the event; you give the prize. Under inheritance and gift tax legislation, the organiser of a contest is obliged to declare the tax withheld from prizes (VİV Law, Art. 7). For this reason the tax (VİV) on prizes won by score is yours: if a tax arises, withholding, declaration and payment are yours. The rate is 20%; for a prize in kind the invoice value is the basis. The declaration is filed by the evening of the 20th of the month following the day the contest was held. Prizes are exempt from tax up to an exemption amount that is determined anew every year (VİV Law, Art. 4); checking how this amount applies, and withholding and declaring when it is exceeded, is up to you.

FLIT does not withhold, declare or pay tax on your behalf. If the tax office asks FLIT for this obligation, FLIT passes the amount it paid on to you by recourse. Events that FLIT opens from its own brand account are organised by MFB; their tax is MFB's.

7. Player data

No player's identity goes to you: username, email, phone, address and account number are never sent. On the panel you see only aggregate numbers.
When a player shows a code on their phone at your counter, you see only the code, the discount or prize, and the time. You use this information only to apply the discount or prize and do not try to identify or track a player.
You have no obligation to report on players to FLIT; nor are you obliged to give FLIT a sales report.
Complying with Law No. 6698 for personal data you obtain through your own channels is up to you. You do not try to match any information you see through FLIT with a player.

8. First-publication review

Before making its first publication public, a new brand completes its company information, accepts the current texts and views the Brand Representative Information Notice. The first publication, whichever comes first, an event or a Vitrin discount, passes FLIT's approval. This is not a sales conversation but a trust check that you are a real brand; what is reviewed is the brand itself.

After approval, including a brand in the trial period, you can give everything written in Article 3; later publications do not require an additional review (except the additional verification for an event with a physical prize). If we ask for changes, you can correct and resubmit. A rejection does not publish the application concerned; unless there is an explicit account sanction decision, it does not mean your account is closed.

9. Trial and fees

A Vitrin offer carries no separate fee. Apart from the panel fee, you pay FLIT no fee, commission or share for opening a discount in Vitrin, uploading codes and being shown. The rules of Vitrin are in the Vitrin Participation Terms.
In an event you pay only per player who plays. A player who plays is one who completes the event to the end: in a tournament, one who completes the questions of the session; in a live contest, one who stays until the end of the contest; in a prediction, one who submits their prediction; in a survey, one who answers all the questions. There is no fixed fee per event; participant charges are calculated together with the monthly panel fee as set out in the item below. Whether an event has ended and the number of participants are based on FLIT's server records; you see the number of participants on the panel.
Panel fee. You pay a monthly panel fee for the brand panel, even if you use only Vitrin. The panel fee starts in the calendar month your first event or your first Vitrin offer goes live; no panel fee is charged for that month and the month after it. For every month after that the panel fee is TRY 500 (VAT included) and covers that month's participant charges up to TRY 500; participant charges above that are added. Example: a month with TRY 800 of participant charges comes to TRY 800, a month with TRY 200 comes to TRY 500. A brand that has never published anything pays no panel fee. The amount of the panel fee and the usage it covers change only for the future and with your explicit acceptance.
Because phone verification is not required to take part, the same person can take part with more than one account; the fee is per account. Taking part with more than one account is forbidden under FLIT's rules.
Unit fees include VAT; they are written on FLIT's price card and shown to you on the panel before you create the event. The fee of an event you have opened stays fixed. FLIT does not change the fee unilaterally: a new fee applies only to newly opened events and with your explicit acceptance.
Admin-created brand exception. A brand account created by a FLIT administrator and recorded as such has a permanent monthly panel fee of TRY 0. The TRY 500 included participant allowance does not apply to this account. If you create events, the trial and completed-participant charges still apply. Later changes to account management do not remove this exception.
Trial: once for each legal business, 30 days or 3 events, whichever is used up first. There is no fee during the trial. Trials started before this version continue with 4 events. The trial counts from the first approved publication; more than one brand linked to the same legal business shares a single trial entitlement, and it is not renewed by changing accounts. An event you cancel does not give back a trial entitlement that has been used; a separate, recorded correction may be applied for a verified technical error attributable to FLIT.
Paid billing does not start until FLIT turns it on, and until that day nothing is collected from you. When the trial ends, paid billing does not start by itself; while paid billing is not on, a brand whose trial entitlement has been used up cannot open a new event and continues to use Vitrin. How it will work when paid billing is turned on is written in the next article.

10. Paid billing: card, automatic charge and invoice

This article describes how things work once paid billing starts; until that day nothing is charged. Storing your card and charging it automatically every month are terms that could be regarded as to your detriment. For this reason, for them, separately from your accepting these Terms, we ask for your explicit consent through a separate box that appears unticked on the panel. Accepting these Terms does not mean giving that consent; if you do not give it, your card is not registered and no charge is made.

Who stores the card. The card is stored by the licensed payment institution iyzico; FLIT does not store it. FLIT keeps only a token that identifies the card at iyzico and the results of charges. You register the card on the panel and declare that the card belongs to the brand and that you are authorised to have it charged.
When and for what it is charged. The amount for each month is charged automatically from your registered card at the beginning of the month following that month, in arrears. There is no advance collection.
How the amount is calculated. The amount is the number of players who completed your events to the end in that month multiplied by the unit fee of the event type (Article 9). The count is according to FLIT's server records and is visible on the panel. You can object to an amount within 30 days by writing to info@mfbteknoloji.com.
VAT. Unit fees include VAT.
If a charge fails. If a charge fails, it is retried on the 3rd and 7th day after the first failed charge. If the amount is still unpaid at the end of the 8th day, you cannot open a new event. Your events that are running at that time continue until they end, because the promise of prizes and discounts given to players is not broken.
Changing and removing the card. You can change or remove the card from the panel at any time. If you remove the card, you cannot open a new event; a debt that has already arisen does not go away.
Invoice. We issue your invoice automatically as an e-invoice or e-archive invoice through Paraşüt and send it to the brand's registered email address. It is up to you that the company name, tax ID number and address required for the invoice are correct.

The version and time of this consent and the consenting account are recorded; a copy of the text you consented to comes to your email.

FLIT collects only its own service fee. It never receives, holds or transfers money on behalf of anyone else: the money for prizes, discounts and sales does not pass through FLIT. FLIT is not a payment institution; the card is processed by the licensed payment institution.

11. Cancellation

Your request to cancel an event does not stop the event instantly. The request goes to FLIT's review; until the cancellation is final, the event and the records that arise continue. A tournament and a live contest can be cancelled only before they start; a survey while it is live; a prediction while it is live or in result review. An event that has ended and an event for which a prize claim has been received cannot be cancelled.

Cancellation does not take back participation: the participation discounts and prizes players have received stay in place. A fee arises for players who completed the event to the end up to the cancellation. An ordinary cancellation does not restore the trial entitlement.

12. FLIT's intervention

In the case of security, fraud, unlawfulness, harm to players, prize or delivery risk, a notice from the Advertisement Board or the Ministry, or a breach of these Terms, FLIT may decline to publish, stop or place under review an event or a discount; in the case of debt or a serious breach, it may limit the capabilities of your account or suspend the account. FLIT stopping an event does not remove the prize a player has won or the discount a player has received up to that moment; you continue to fulfil them.

13. Organiser, liability, Apple and Google

You are the legal organiser of the event; MFB operates the platform. An event that FLIT opens from its own brand account is organised by MFB, and its screen states that the organiser is FLIT.
FLIT provides the platform's technical publication and record layer; it does not assume your commercial promise. It is not the seller, supplier or guarantor of the product or service that is the subject of the prize or discount. Obligations on sales, payment, delivery, returns and warranty are yours.
You warrant that you hold the necessary right of use for the content and marks you upload. You are responsible for any third-party claim, administrative sanction or loss to the extent it arises from your own breach. FLIT's liabilities arising from mandatory legislation are reserved.
In the app, the official rules can be opened inside each event and include this sentence: "Apple and Google are not sponsors of this event and are not involved with the event in any way."
If Apple does not accept brand events with prizes, these events may be closed on iOS; this affects only your number of participants, because the fee is only per player who plays.

14. Version and acceptance record

When these Terms or the Brand Agreement change, the new version takes effect, before you open a new event, with your explicit acceptance again on the panel; there is no silent acceptance. Events you opened under an earlier version continue under that version; a change to your detriment does not apply retroactively. The version of your acceptance, its time and the accepting account are recorded. These texts are always open on this page; you can print or save them.
